Make It Sustainable Ltd Terms and Conditions of Hire
All hire of space at The Old Print Works (OPW) is subject to our Hire Policy and the following Terms and Conditions. By booking space at OPW, the Hirer is agreeing to these Terms and Conditions. Any variation from these must be stated and signed in a written Hire Agreement.
MIS reserves the right to refuse access to individuals and organisations at any time.
The Hirer is responsible for the good behaviour of all their guests.
Smoking or vaping inside the building and the use of drugs and other illegal substances anywhere on the premises is strictly forbidden.
The Hirer will not do anything on or at the premises which
- may be or become a nuisance or annoyance to any other occupiers of the Property or owners or occupiers of adjoining or nearby premises;
- is illegal;
- may in any way affect the validity of the insurance of the Property or its contents or cause an increase in the premium payable by MIS.
Total numbers of people on the premises must not exceed MIS’ stated capacities of the different spaces.
The Hirer’s activity will be described on their agreement. Any additional, or variation to, content or activity, in particular political messaging, canvassing, fundraising or recruitment of volunteers to any cause must be agreed with MIS beforehand.
Unless otherwise stated above, the Hirer is responsible for their own set-up and set-down of the space they hire, to deposit any refuse in the appropriate bins, to remove all personal items (including own furniture and equipment) from the premises before leaving, and generally to leave the space in the condition they find it in.
The Hirer will not use any noxious substances or do anything that will permanently alter the space.
The Hirer will not use any fire, naked flame, fireworks or flammable substances without prior agreement with MIS. Use of smoke machines or anything likely to affect smoke detectors must be agreed in advance.
The Hirer is responsible for their own First Aid provision. Use of the premises is at the Hirer’s and their visitors’ own risk.
Whilst at OPW the Hirer and their visitors are subject to MIS' policies.
MIS is not responsible for any items used at the event; anything remaining after the event may be disposed of at the Hirer’s expense. Lost Property will be kept for 3 months.
OPW is a building with many users and as such hirers are responsible for any children or vulnerable people attending their event.
A deposit will be charged, payable prior to the event, returnable on inspection of the premises being satisfactory; the cost of repairing any damage/theft/mess caused by the hirer or their guests will be charged to the hirer if it exceeds the value of the deposit (£20 charge if not left as found, £40 if excessive, up to whole deposit if further remediation required).
MIS shall be entitled to have and retain keys for all the doors to the hired space and to obtain access as necessary.
The whole OPW premises is a NO SMOKING and NO VAPING area, except permitted outside areas.
Car parking is limited on the OPW site. The courtyard is for pedestrians, loading/unloading and disabled parking. After unloading the hirer must remove their motor vehicle from site.
The event will be staffed at all open times by the Hirer. Signage will be provided by the Hirer.
The responsible person as per the Hire Agreement will remain on site throughout the set-up, event and set-down, and will not be under the influence of alcohol or illegal drugs.
The Hirer is responsible for providing Public Liability Insurance and any other insurance they require.
MIS may at any time give the Hirer notice to leave the premises immediately in the event that activities are deemed unfavourable to OPW or MIS in any way.
A risk assessment is required for any events where alcohol will be served, if more than 30 people are expected or if any unusual activities are planned.
SIA-licensed security to be provided at the Hirer's expense if the event runs after 10pm, serves alcohol or expects 150 people or if MIS deems it necessary.
The Hirer should ask before using any items found at OPW, and they do so at their own risk.
Temporary Event Notices (TEN):
It is the Hirer’s responsibility to serve a TEN if planned activities fall within the requirements of a TEN.
If a TEN is required, the Hirer should liaise with MIS 3 weeks in advance of the event, and are responsible for submitting this to Birmingham City Council in good time, and receiving satisfactory authorisation for the event to go ahead.
Payments for the event as above should be in place prior to any TEN being served.
Confirmation of the TEN should be shared with the MIS team and deemed confirmation must be in place before the event to avoid cancellation and must be displayed on the night as per the regulations.
If insurmountable objections are raised by the authorities, the event booking can be cancelled at any time up until the date of the event. We would therefore advise the Hirer to submit their TEN in plenty of time.
